The EU-U.S. Privacy Shield: Practicalities for U.S. Businesses

On August 1, 2016, the U.S. Department of Commerce began accepting applications for certification under the new EU-U.S. Privacy Shield.

The Privacy Shield places participants under closer scrutiny from the Federal Trade Commission than was the case under its predecessor, the EU-U.S. Safe Harbor, and introduces new obligations such as liability for onward transfers and the provision of free, independent dispute resolution to data subjects.
