The team achieved a significant defense victory in a five-week bench trial for Assured Guaranty in connection with litigation seeking more than $1.4 billion in claims related to the collapse of Lehman Brothers. New York’s Appellate Division, First Department turned back a request from Lehman Brothers International (Europe) to revive its claim regarding the valuation of certain financial contracts and upheld Assured’s win of more than $50 million in counterclaims and interest, finding “no basis to disturb the trial court’s determination, which is based upon its resolution of conflicting expert testimony.”
