On February 5, 2016, George Cary will participate in a panel discussion titled “Lawyer Regulation and Antitrust Law in the wake of N.C. State Board of Dental Examiners v. FTC,” as part of the Association of Professional Responsibility Lawyers (APRL) Mid-Year Meeting.

The US Supreme Court ruled that a state licensing board controlled by “active market participants” does not enjoy automatic state-action immunity from antitrust suits. Instead, immunity requires that the board act pursuant to clearly articulated state policy and be “actively supervised” by the state. This panel will explore the implications of that holding for lawyer regulation, where practicing lawyers have significant roles in regulatory bodies.
