Cleary Gottlieb partner Sean O’Neal was a speaker at the University of Pennsylvania Institute for Restructuring Studies: The Intersection of CDS and Restructuring panel discussion.
Sean spoke about the use—and, some may argue, abuse—of CDS and whether certain practices should be permissible—and, if reform is needed, from where is it presently underway or yet most likely to emerge. The panel also explored what impact so-called manufactured defaults could have if the result is a chapter 11 filing by the borrower.
