Two recent judgments of the Italian Supreme Court addressed a number of financing issues regarding distressed companies (in the context of concordato preventivo proceedings) envisaging invoice-backed lending and debt rescheduling. Michele Ciprietti discussed the key issues raised by these judgments and its implications for restructuring purposes.
