Antitrust compliance programs: from corporate governance tool to mitigating circumstance in the quantification of fines. The state of the art in light of the Guidelines of the Italian Competition Authority.
From a company’s perspective, adopting an effective antitrust compliance program is key to prevent infringements of competition law, in addition to being a possible mitigating circumstance that may be taken into account by the Italian Competition Authority when setting antitrust fines. Two and a half years after the issuance of the Italian Competition Authority’s Guidelines, Alice Setari and Natalia Latronico discussed the state of the art in this regard, by providing an overview of the contents of an effective antitrust compliance program and by analyzing recent case-law.
