Cleary Gottlieb partner Romina Polley spoke in the webinar, “Self-Preference as Abuse Sui Generis?” which was organized by the Munich Antitrust Forum (Münchener Kartellrechtsforum).

Romina discussed the ECJ’s recent Google Shopping decision of November 10, 2021, that confirmed the European Commission’s decision against Google, which established self-preference as a new category of abuse of a dominant position. Romina also discussed the prohibition of self-preferential treatment, now included in the new Section 19a of the German Competition Act (Section 19a GWB) enabling the authority to intervene earlier and more effectively, in particular against the practices of large digital companies.
