Abengoa Solar España in Enforcement Proceedings of an Arbitral Award

Cleary Gottlieb successfully represented multinational listed company Abengoa Solar España S.A. in enforcement proceedings of an arbitral award under the 1954 New York Convention. On October 8 2013, the Court of Appeal of Palermo gave an order granting Abengoa’s request to declare the efficacy in Italy of an ICC arbitral award rendered in a dispute against Italian company One Consulting S.r.l.

The award was delivered by an arbitral tribunal with its seat in Madrid, which had found One Consulting in breach of the Framework Agreement for the development of photovoltaic projects in Italy entered into with Abengoa, declared that Abengoa’s termination of such agreement was legitimate and granted the latter damages.
