Acciaierie d’Italia Wins Again Before the Court of Milan

Cleary Gottlieb represented Acciaierie d’Italia S.p.A. (Acciaierie d’Italia) in its win in the Court of Milan.

The Court of Milan rejected a new petition under Article 700 of the Italian Code of Civil Procedure in which a contractor, as part of two complex proceedings for damages, had requested from Acciaierie d’Italia the immediate payment of substantial amounts, both for the price of services allegedly carried out and for compensation and indemnification in relation to various contracts for the contracting of works within the former Ilva plant in Taranto.

Accepting Acciaierie d’Italia’s arguments in full, according to a note from the lawyer, the Court of Milan dismissed the contractor’s applications for precautionary measures, ruling out, among other things, a link between Acciaierie d’Italia’s conduct and the alleged risk of insolvency and, therefore, excluding the existence of periculum in mora (urgency).
