Cleary Gottlieb a ‘Litigator of the Week’ Finalist for Allergan Win

Cleary Gottlieb partners Roger Cooper and Jared Gerber, and associate Anna Connolly have been selected as finalists for The American Lawyer Litigation Daily’s “Litigators of the Week” for their work representing Allergan in securing a rare order denying class certification in a securities class action.

The Cleary team represented Allergan in a September 29, 2020, summary judgment in which Chief Judge Colleen McMahon of the U.S. District Court for the Southern District of New York denied a motion for class certification brought by Boston Retirement System, taking issue with the fee-sharing arrangement between two plaintiffs firms who split work on the suit again Allergan. McMahon found that plaintiffs firms defied her explicit instruction that there should be only one law firm serving as lead counsel and that the latter firms’ continued work on the case as “additional counsel” was “the quintessential example of a lawyer driven arrangement.”
