Cleary Gottlieb Wins GCR Litigation of the Year Award 2019 for Auto Parts Antitrust Litigation

Cleary Gottlieb has been recognized as counsel to Japanese bearings manufacturer NSK in the multidistrict antitrust suit brought by direct purchasers of bearings over alleged price fixing, which won a Global Competition Review (GCR) Litigation of the Year award for cartel defense.

In a major litigation victory, the U.S. District Court for the Eastern District of Michigan accepted the arguments that Cleary advanced in the briefing and at oral argument, and denied the plaintiffs’ motion for class certification, ruling that the plaintiffs failed to satisfy the requirements of typicality and adequacy. Among other things, the court agreed that the plaintiffs were very different from most bearings purchasers and would not be proper representatives of class members like large original equipment manufacturers.
