The UK’s New Plan for Immigration: Concerns About Legality and Proportionality

The UK’s Home Secretary, Priti Patel, has announced a New Plan for Immigration (open for public consultation until 6 May 2021), which seeks to overhaul the UK’s immigration system, with a significant focus on targeting “illegal immigration”.

The New Plan for Immigration proposes that “For the first time, whether people enter the UK legally or illegally will have an impact on how their asylum claim progresses, and on their status in the UK if that claim is successful.”

The New Plan for Immigration appears to raise concerns. There is a question as to the extent to which the proposals are consistent with the Refugee Convention. There is a further question as to whether the proposals are in line with the principle of proportionality.
