On March 2, 2017, Cleary Gottlieb partner Kenneth S. Reinker participated in a panel discussion titled “State Action Immunity: From NC Dental to Texas Telemedicine,” as part of the ABA Antitrust Section’s Health Care and Pharmaceuticals Committee program.
The panel reviewed circumstances in which in which states and non-state actors are immune from antitrust enforcement, more recent enforcement actions and states’ responses, including reviews of professional boards and regulations restricting competition, FTC guidance and new state legislation extending antitrust immunity to merging parties.
