Cleary Gottlieb acted as counsel to SKY Italia in obtaining the dismissal of a second application for interim measures filed with the Tribunal of Milan by Conto TV, a TV broadcaster of sports and other programs, in a dispute concerning breaches of contractual obligations. With a decision issued on August 29, 2013, the Tribunal of Milan confirmed the previous order of August 1, 2013 and dismissed Conto TV’s allegations, including those based on antitrust and regulatory matters. A panel of judges confirmed that SKY Italia legitimately stopped providing services to Conto TV, due to its serious and repeated contractual breaches.
In July 2013, SKY Italia had brought an action against Conto TV before the Tribunal of Milan in connection with the same matter.
