Cleary Gottlieb acted as counsel to SKY Italia in obtaining the dismissal of a class action lawsuit brought by one of SKY Italia’s customers, which was backed by a leading Italian consumers’ association.
The contract claim was brought under newly enacted rules that have introduced class action lawsuits into the Italian system and concerned SKY Italia’s broadcasting and advertising rights for Italian Series A League soccer matches.
The Court of Milan issued its decision on February 12, denying the certification of the class action, holding that the plaintiff’s claims were without basis and ordering that the plaintiff pay SKY Italia’s legal fees.
