Telecom Italia Wins Antitrust Dismissal

Cleary Gottlieb successfully represented Telecom Italia S.p.A., Italy’s largest phone operator, against an antitrust claim filed by Telextra, a directory assistance operator, before the civil court of Milan. Telextra sought an interim decision ordering Telecom to make available all of the data relating to its subscribers to the voice telephony service.
According to Telextra, Telecom was irreparably damaging competition in directory assistance services by refusing to provide its competitors with all of the subscriber data collected due to its dominant position in fixed telephony services. The Court of Milan dismissed Telextra’s action, finding that Telecom was fully compliant with EU and Italian legislation on the creation of a single database for directory assistance services, and ordered Telextra to pay Telecom’s legal expenses.
