Xella Obtains Annulment of IAA Decision

Cleary Gottlieb successfully represented Haniel Group’s subsidiary and the world’s largest producer of autoclaved aerated concrete Xella International GmbH in its appeal of an Italian Antitrust Authority decision imposing fines and structural remedies.

Concluding a two-year investigation, the IAA had fined Xella for its alleged participation in an anticompetitive scheme with its main competitor in the market for autoclaved aerated concrete in Italy, RDB S.p.A. The IAA had also ordered the dissolution of a production joint venture between Xella and RDB that, in its view, constituted an essential element of the alleged infringement. The Regional Administrative Court in Rome upheld Xella’s claims and quashed in full the decision’s findings against Xella. The full text of the judgment will be published within the next few months.
