Cleary Crypto Team Files Amicus Brief For Paradigm In Uniswap Patent Case In Support of DeFi Innovation

Cleary was proud to file an amicus curiae brief on behalf of leading crypto research and investment firm, Paradigm, discussing the important role that the proper application of patent law has in supporting decentralized finance (DeFi).       

In BProtocol Foundation v. Uniswap Labs, 25-cv-4214-JGK (S.D.N.Y.), plaintiffs allege that Uniswap Foundation and Uniswap Labs infringe patents related to an automated market-making system on a blockchain.    

The patents attempt to monopolize a basic economic concept: using a mathematical formula to set exchange rates for currency trading. By tracing the historical and technical foundations of digital asset exchanges, Paradigm’s brief explains that these activities existed long before blockchains or crypto. And by describing the evolution of Supreme Court and Federal Circuit precedent, Paradigm’s brief explains why these patents are invalid. 

DeFi is at an inflection point and Paradigm’s brief in this case offers a unique perspective on why well-calibrated intellectual property law matters in DeFi.
