Cleary Gottlieb Partners Named ‘Litigators of the Week’ Finalists for Bosch Win

Cleary Gottlieb partners Carmine Boccuzzi, Alexis Collins, and Matthew Slater were selected as “Litigators of the Week” finalists by The American Lawyer’s Litigation Daily  for securing a win on behalf of Bosch in the Court of Appeals for the Ninth Circuit related to the Volkswagen dealers’ proposed $1.2 billion class action.

The Ninth Circuit agreed with U.S. District Judge Charles Breyer’s decision that the Volkswagen dealers’ claims of future lost profits were not proximately caused by the alleged Racketeer Influenced and Corrupt Organizations Act (RICO) violation, and therefore the dealers had no standing to bring their RICO claims against Bosch. The Ninth Circuit also affirmed dismissal of the dealers’ state law claims for lack of proximate cause.
